Agreement of Maintenance between Husband and Wife: An Analysis in the Light of the Sharī‘ah and Law

Abstract

Islamic sharī‘ah, through the contract of marriage (nikāḥ), establishes a set of rights and obligations for both the husband and wife. Among such rights and obligations is nafaqah (maintenance). Maintenance is the right of a married woman and it is obligatory for her husband to provide her with it. According to Islamic law, the maintenance comprises shelter, food, clothing, necessary domestic equipment and providing assistant(s), where it is applicable. This article outlines the debates associated with the maintenance of married women in the light of the sharī‘ah and Pakistan’s Family Law.
