Abstract

Custom (‘urf) is the secondary source of Islamic law. Classical Muslim jurists especially, the ╓anafis, have discussed the status of custom as a source of Islamic law. They pointed out in their writings numerous shari‘ah rulings, which were based on customs and usages of the people. This paper seeks to analyse the impact of custom, as a source of Islamic law, on modern financial transactions. It is divided into two sections. The first section consists of introductory information about custom i.e., its meaning, kinds, conditions, and validity. The second section deals with the impact of custom (‘urf) on modern financial transactions, namely the transactions related to sale, lease, agency and intellectual property.
