Abstract

Islam is the way of life (din) revealed by the Creator for the guidance of mankind in all affairs of the individual as well as collective spheres of life, starting from its very inception with Adam (peace be on him). Its teachings have been continually revised and changed through revelation (wahi) to the succeeding Prophets and Messengers (peace be on them all) to meet the changing needs of humans with the passage of time and the changing socio-political circumstances. The final version of Islam for the rest of time was revealed to the last and final Prophet and Messenger Muhammad (peace be on him). This version, to meet the changing needs of humanity till the last day, contained along with permanent foundations and principles the mechanism of ijtihad to reinterpret the basics to formulate the new laws or reformulate the existing laws to meet the new challenges. Flexibility to adapt according to new socio-political as well as time-space situations, thus, becomes a salient feature of Islamic law and jurisprudence. This article, delving into the examples from the Quran, the Sunnah, the Sirah and the Fiqh literature, argues that consideration of the given situation regarding personal,
environmental and socio-political circumstances is one of the major factors in the process of ijtihad and reformulation of the laws in Islamic Jurisprudence.
