Abstract

Taxation is one of the main sources to finance the budget deficit. Now a days tax evasion is a very common social evil. In this study it has been discussed whether an Islamic State can levy taxes besides the zakat, sadaqat and other voluntary charities? The paper also explores whether the right of the Islamic state to levy taxes is unconditional? If the Islamic State imposes the taxes and its citizen evade to pay them, then whether tax evasion is only a crime or a sin as well? This is the main focal point of this article. To fulfill the basic needs of the poor and destitute is the obligatory duty of the prosperous. This study concludes that if just and fair taxes are imposed only to fulfill the basic needs of the poor, and not for the extravagancies of the rulers, then tax evasion will not only be a crime but also a sin.
