Abstract

The varying questionable procedures of the implementation of the punishment of imprisonment have drawn the attention of many scholars to explore its very validity in the Islamic legal system. This article analyses the Islamic Legal Position of the sentence of imprisonment in the light of relevant verses of the Glorious Qur'an and the interpretations of these verses by the eminent Muslim Commentators (mufassirun) along with their arguments. It provides evidence that unjust and cruel practices of this sentence are condemned by the Qur'an. The Qur'an disapprovingly mentioned the imprisonment of the Prophet Yusuf (peace be on him) highlighting the injustice and cruelty in its initiation and implementation. This paper further brings to the fore that analysis of the interpretation of the relevant verses by the Muslim Commentators shows that the Qur'an did not repeal the punishment of imprisonment though it condemned its unjust and cruel implementation. The Qur'an further provides grounds for application of this punishment in a lenient manner to deal with all ta 'zir crimes, civil and financial wrongdoings and for non payment of debts. The Muslim Jurists (fuqaha') and Commentators further suggest reduction and leniency in the laws of imprisonment of various degrees depending on the severity of the crime and haughtiness of the criminal.
