Abstract

In Islamic law maintenance (nafaqah) is the right of a dependent child on its father to be maintained during minority. Maintenance is a duty which arises out of guardianship (wilayah).As a guardian the father is obliged to pay maintenance to his child in Islamic law as well as in Pakistani law provided the child does not have any income of its own. The responsibility of maintenance is upon the father and varies according to his financial status. In the case of absence or disqualification of the father this duty devolves on other relatives. Islamic law provides detailed rules regarding maintenance of children but these rules are scattered in fiqh manuals. Pakistan on the other hand lacks any legislation on this issue. In Pakistan maintenance is mainly governed by Muslim Personal law and by the decided cases of the superior courts. This paper explores the rules regarding maintenance of the child in Islamic law so that it may serve as a guideline to formulate a comprehensive legislation on this issue in Pakistan. Case law is analyzed to examine and analyze the approach of Pakistani courts. At the end the conclusion will summarize the findings.
