پاکستان میں قانون زکوٰۃ کی تدوین کا ایک تنقیدی جائزہ

Abstract

In the early Islamic civilization, the process of zakāt had been carrying out without any interference till the 7th century A-H, when Tātārs changed the process as they said that the distribution of zakat would be by the people themselves as it could not be distributed to the Non-Muslims. Since then, the same process is being practiced in the subcontinent of Indo-Pak. In 1973 with the constitution of Pakistan, a decision was made to establish a committee for managing the affairs of zakāt, under the article 31(2)(c). For the legislation of zakāt Process, on 8th may, 1976 the “Council of Islamic Ideology” suggested to use the zakāt Law of AJK 1974. On July 5th Martial Law was declared. In 1979 the idea of Zakāt Council was put forth. Zakat and Usher Ordinance was announced on June 20th, 1980. It was the first law of zakāt in Pakistan. Till 1997, no amendments were made, but in the same year several changes came into being by the National Assembly of Pakistan, regarding zakāt. Later in 2003, disbursement procedure of zakāt program was introduced by the Ministry Of religious Affairs (MORA), Pakistan. In 2004, Khalid Nazir, a research scholar in (IIUI) discussed the importance of zakāt Law and how this law was made throughout the history. Most of the laws of zakāt were made during the military regime. The Parliament of Pakistan accepted these laws. Further research work is required on this issue to eliminate the flaws present in today's laws of zakat so that they can be implemented properly and we can get more benefits that will result in better socio-economic situation. A critical study of the legislation of the zakāt law is conducted in the present work.
