الملخص

The Advisory Council of Islamic Ideology had recommended in 1962 that an apostate would not be a legal heir of a Muslim. The Institute of Islamic Research declared it against Islam and pronounced that according to Sharia a Muslim cannot become a heir of a non-Muslim and not even a non-Muslim can become a heir of a Muslim. Along with this the Institute also criticized the punishment of death penalty awarded to an apostate. The Council took this under consideration and deemed it unrelated to its recommendation by further enhancing the scope of its recommendation and reiterating its previous recommendation. In the article under observation, the critical analysis of both viewpoints is presented. Also after 1984, the Council of Islamic Ideology had sent a bill, termed as Apostasy Law, to the Government of Pakistan. While critically analyzing the said law, six problems are brought under discussion and during discussion over repentance the decision of Federal Shariat Court is also brought under discussion.
