Abstract

Pakistan is an ideological state created in the name of Islam. Muslims of India needed a place where they could do practice Islamic laws and principles freely. The Islamization of laws in Pakistan started after 1960. Many Islamic institutions were created for this purpose: the council of Islamic Ideology is one of them.  The Council was established in 1962, under the government of Ayub Khan, designated as Islamic Advisory Council. It was re-designated in 1973 as Council of Islamic Ideology. The Council is a constitutional body of Pakistan that advises the legislature whether or not a certain law is repugnant to Islam; namely, the Qur’ān and the Sunnah and responsible for giving legal advice to the Parliament in this regard. This paper analyses the role of the Council for Islamization of law of Inheritance. Meanwhile, special focus will be on the issue of inheritance of an Orphan (grandson/ daughter) and the opinion of the Council.
