Abstract

There has always been an Islamic state on any part of the globe. Despite the weaknesses in personal lives of the rulers, Islam has been the “constitution” for them. In pre-colonial Muslim world laws violating the injunctions of Islam were never implemented as frequent as the postcolonial periods. Pakistan also inherited certain such laws from the Company’s government. Pakistan was created to implement Islamic laws and principles. Its Constitution, thus, stands Islamic one and accordingly many laws tried to be in conformity with the Injunctions of Islam. That includes the personal laws as well. It gives rise to debate over the compatibility or otherwise of such laws with the Injunctions of Islam especially the issue of divorce and inheritance of grandchild. The present paper aims to analyze these two issues and recommendations will be made in the context of Malaysia.
