فقه المحدثين من خلال تراجم الأبواب (حديث: "خذي ما يكفيك وولدك بالمعروف".. أنموذجًا) -دراسة حديثية تحليلية مقارنة-
Abstract
Abstract:
This research aims to highlight the jurisprudential orientation of hadith scholars through their works and to implicitly refute the claim that hadith scholars have no jurisprudence in narrations. The researcher discusses the biographical entries of hadith books, after extracting the hadith from its sources and stating their biographical entries. The researcher also demonstrates the position of the Prophet (peace be upon him) in guiding Hind bint Utbah when she asked him about a matter, and the rulings that follow from it.
The researcher aims to reveal the jurisprudential tendency of hadith scholars in applying this hadith through their works, and to show that their jurisprudence is manifested in the hadith by stating the position of the Prophet (peace be upon him) through this guidance. The researcher reached several conclusions, including the status of the jurisprudence of hadith scholars in their works, especially in the third century where their jurisprudence was highlighted in their biographical entries, with consideration and deduction from them. The research also included the opinions of eight hadith scholars who narrated the hadith in their works and showed their jurisprudence on its issues. They agreed that it is a position of issuing fatwas, and that it is the basis of the Sunnah, and does not depart from it except with evidence, as the Prophet (peace be upon him) is the messenger of Allah who came to clarify the Shariah to all people.
Keywords: Jurisprudence of hadith scholars, nafaqah, biographical entries of hadith books.
