Legal Status of the Doctor’s Mistakes in Islamic Law
الملخص
This article explains an important issue known as the "doctor’s mistakes" in light of the Islamic law. This term refers to a mistake committed by a medical practitioner during his or her profession, which may cause damage to the health of the patient. The reasons for medical errors and mistakes include negligence, lack of precautions, or non-observance of the related rules and laws. I have discussed in this article different views of Muslim jurists regarding legal responsibility of the doctors for their professional mistakes. The article concludes that according to the preferred opinion of the Muslim jurists, medical practitioners are not responsible for their mistakes, unless they are proved guilty on the grounds of concrete evidences.
